These Terms of Service ("Terms") govern your access to and use of the AstroIQ mobile application ("AstroIQ", "the app", "we", "us", or "our"). AstroIQ is operated by Davide Mancini (ABN 40 426 287 852), a sole trader based in Western Australia.
By downloading, accessing, or using AstroIQ, you agree to be bound by these Terms. If you do not agree, please do not use the app.
AstroIQ is an astrophotography session-planning tool that provides estimates of night-sky conditions (including moon phase, sky darkness, atmospheric transparency, and weather), deep-sky target information, framing and field-of-view calculations, and equipment management. AstroIQ is intended for personal, informational planning use only.
The sky quality scores, weather forecasts, astronomical timings, and other information provided by AstroIQ are estimates generated from third-party data and calculations. They may be inaccurate, incomplete, or out of date.
You should not rely on AstroIQ as your sole source of information for any decision. Weather and sky conditions can change rapidly and unpredictably. You are responsible for verifying conditions independently and for your own safety and that of your equipment. To the maximum extent permitted by law, we accept no liability for any loss, damage, missed session, or equipment issue arising from reliance on the app.
You must be at least 16 years old to use AstroIQ. By using the app, you confirm that you meet this requirement.
AstroIQ offers premium features through an auto-renewing subscription, purchased and managed through the Apple App Store.
New subscribers may be offered a 7-day free trial. If you do not cancel at least 24 hours before the end of the trial, your subscription will automatically convert to a paid subscription and you will be charged.

All prices are in Australian Dollars (AUD) and include any applicable taxes unless otherwise stated. Prices displayed in the App Store at the time of purchase apply. We may change subscription prices in future; any change will apply only to subsequent billing periods and will be disclosed before it takes effect.
Your subscription automatically renews at the end of each billing period (monthly or yearly) at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
Payment is charged to your Apple ID account. You can manage or cancel your subscription at any time through your device's subscription settings (Settings → your Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period, and you will retain access to premium features until then. Deleting the app does not cancel your subscription.
All purchases are processed by Apple. Refund requests are handled by Apple in accordance with Apple's policies. We do not process payments directly and generally cannot issue refunds ourselves.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use AstroIQ for your personal, non-commercial use, subject to these Terms.

AstroIQ, including its design, code, branding, and original content, is owned by us and protected by intellectual property laws. Astronomical facts and catalogue data (such as object coordinates, sizes, and designations) are factual information and are not claimed as our proprietary content. Any photographs you add remain yours.
AstroIQ uses third-party services, including Open-Meteo (weather data) and the Apple App Store (subscriptions). We do not control these services and are not responsible for their availability, accuracy, or practices. Your use of those services may be subject to their own terms.
To the maximum extent permitted by law:
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to the resupply of the service or the cost of resupply.
We may suspend or terminate your access to the app at any time if you breach these Terms or where required by law. You may stop using the app and delete it at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
We may update these Terms from time to time. Changes will be reflected by the "Last updated" date above and, where appropriate, communicated within the app. Your continued use of AstroIQ after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia.
